Thank you for considering Worldwide Inc. for your next vehicle purchase. We are committed to providing quality commercial trucks and vehicles while making your buying experience as smooth and transparent as possible. Please read these Terms & Conditions carefully before placing a security deposit or purchasing any vehicle.
Vehicle Condition
Unless otherwise stated in writing, all vehicles sold by Worldwide Inc. are sold "AS IS", "WHERE IS", with NO WARRANTY, either expressed or implied.
Worldwide Inc. expressly disclaims, to the fullest extent permitted by applicable law, all warranties, including but not limited to:
- Implied Warranty of Merchantability
- Implied Warranty of Fitness for a Particular Purpose
- Any other express or implied warranties
The purchaser assumes full responsibility for the vehicle and all repairs, maintenance, defects, or conditions that may presently exist or arise after delivery.
Worldwide Inc. shall not be liable for any consequential, incidental, special, or indirect damages, including but not limited to:
- Loss of use
- Loss of time
- Loss of profits or income
- Towing expenses
- Rental vehicle expenses
- Property damage
- Any other damages arising from the purchase, ownership, or operation of the vehicle.
No employee, salesperson, or representative of Worldwide Inc. is authorized to make any warranty or representation unless it is provided in writing and signed by an authorized representative of Worldwide Inc.
Manufacturer warranties, if still applicable, may transfer to the purchaser. Eligible vehicles may also qualify for optional third-party extended service contracts.
Vehicle Information
Worldwide Inc. makes every reasonable effort to accurately describe each vehicle.
However:
- Mileage may change slightly due to test drives, transportation, inspections, or service.
- Vehicle equipment, options, and specifications should be independently verified by the buyer.
- Used vehicles may have previous repairs, repainting, aftermarket accessories, replacement parts, normal wear, scratches, dents, chips, or other cosmetic imperfections.
Vehicle descriptions, specifications, photographs, videos, and advertisements are provided for informational purposes only and are not intended to serve as warranties or guarantees.
Buyer's Inspection
Worldwide Inc. strongly encourages every buyer to personally inspect the vehicle prior to purchase or have the vehicle inspected by a qualified independent mechanic or inspection service of the buyer's choosing.
It is the buyer's sole responsibility to inspect the vehicle and determine that it meets their expectations before placing a security deposit or completing the purchase.
By placing a security deposit or completing the purchase, the buyer acknowledges and agrees that:
- The buyer has had a full and adequate opportunity to inspect the vehicle or arrange for a third-party inspection.
- The buyer has had the opportunity to ask any questions regarding the vehicle prior to purchase.
- The buyer either completed an inspection or voluntarily chose to waive the right to inspect the vehicle.
- The buyer accepts the vehicle in its current "AS IS, WHERE IS" condition, with all known and unknown faults, except as otherwise required by applicable law.
If the buyer chooses not to inspect the vehicle prior to purchase, the buyer acknowledges that they have voluntarily waived their right to a pre-purchase inspection and accept the vehicle based on their own decision to proceed with the purchase.
No claim regarding the vehicle's condition that could reasonably have been discovered through a pre-purchase inspection shall constitute grounds for canceling the sale, requesting a refund, or disputing the transaction after delivery.
Security Deposit
A security deposit may be required to reserve a vehicle.
ALL SECURITY DEPOSITS ARE NON-REFUNDABLE.Once a security deposit has been received:
- The vehicle is immediately removed from the market.
- Worldwide Inc. may decline other interested buyers.
- Marketing and advertising for the vehicle may cease.
- The deposit will be applied toward the purchase price at closing.
If the buyer fails or refuses to complete the purchase for any reason, the security deposit shall be forfeited.
Exception: If a pre-purchase inspection reveals a major mechanical defect that was not previously disclosed by Worldwide Inc., and Worldwide Inc. is unwilling or unable to repair the defect prior to delivery, Worldwide Inc. may, at its sole discretion, cancel the transaction and refund the security deposit.
Normal wear and tear, cosmetic imperfections, maintenance items, age-related conditions, minor repairs, or buyer's remorse shall not constitute grounds for a refund of the security deposit.
Buyer's Responsibility
The buyer is solely responsible for determining whether the vehicle is suitable for their intended use prior to purchase.
This includes, but is not limited to:
- Vehicle condition
- Mechanical condition
- Cosmetic condition
- Mileage
- Payload capacity
- Towing capacity
- Gross Vehicle Weight Rating (GVWR)
- CDL requirements
- DOT regulations
- EPA emissions requirements
- State inspection requirements
- Registration requirements
- Commercial or personal use suitability
Worldwide Inc. makes no representation that any vehicle is suitable for the buyer's specific intended use.
Payment
Accepted payment methods include:
- Wire Transfer
- Certified or Cashier's Check
- Approved Financing
- Cash (subject to applicable legal limits)
- Full payment must be received and cleared before the vehicle is released.
Financing
Financing is subject to lender approval.
Worldwide Inc. cannot guarantee financing approval, interest rates, loan terms, or down payment requirements.
Taxes, Registration & Fees
Arizona residents are responsible for all applicable sales tax, title, registration, documentation, and licensing fees.
Out-of-state buyers are responsible for all taxes, title, registration, inspection, emissions, licensing, and other fees required by the state in which the vehicle will be registered.
Shipping
Worldwide Inc. can assist buyers in arranging vehicle transportation throughout the United States and internationally.
Shipping costs are the responsibility of the buyer.
Worldwide Inc. shall not be responsible for shipping delays, damage, or loss occurring after the vehicle has been released to the transportation carrier.
Documentation Fee
A documentation fee, title fee, temporary registration fee (if applicable), and any other applicable government fees will be disclosed prior to purchase and are due at closing.
Returned Vehicles
All vehicle sales are FINAL.
Worldwide Inc. does not accept returns, exchanges, or cancellations after delivery unless otherwise required by applicable law.
Limitation of Liability
Worldwide Inc.'s maximum liability arising from the sale of any vehicle shall not exceed the actual purchase price paid for that vehicle.
Governing Law
These Terms & Conditions shall be governed by the laws of the State of Arizona.
Any dispute arising from the purchase or sale of a vehicle shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.
Attorney's Fees
In the event of any legal action arising out of the purchase or sale of a vehicle, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs to the extent permitted by applicable law.
Entire Agreement
These Terms & Conditions, together with the Purchase Agreement, Buyer's Guide, Odometer Disclosure Statement, Title Documents, Financing Documents (if applicable), and any other signed agreements, constitute the entire agreement between Worldwide Inc. and the purchaser.
No oral statement, promise, estimate, advertisement, or representation made by any employee or representative of Worldwide Inc. shall modify these Terms & Conditions unless confirmed in writing and signed by an authorized representative of Worldwide Inc.
Acceptance
By placing a security deposit, signing a purchase agreement, or purchasing a vehicle from Worldwide Inc., the buyer acknowledges that they have read, understood, and agree to these Terms & Conditions of Sale.
